The Career Hub is administered by the Capilano University Career Development Centre. It is an Internet application that facilitates students, alumni and employers to connect online, free of any service charges.

The following terms of use and regulations set out the terms and conditions under which Career Hub is made available to employers and third parties who act on behalf of an employer(s) in order to use the website to post job advertisements. By submitting an account application or opportunity posting, accessing and using the Career Hub website, you are indicating your acceptance and agree to be bound by the below outlined Terms of Use.

The Capilano University Career Development Centre reserves the right to block, delete or decline any account, opportunity posting or any other information in the Career Hub system at their discretion without notice.

Purpose
This Terms of Use policy outlines the requirements and limitations for the use of the Capilano University's online job posting module, Career Hub, ensuring compliance with British Columbia's Employment Standards Act and Pay Transparency Act.

  1. Employer Account Applications:

    1.1. All applications must include the name of an individual at the organization who will be responsible for the account, and contact information must be provided including address, email and phone number.
    1.2. Contact information provided in account applications must match with the organization's website contact information.
    1.3. Employer account applications that do not have matching contact information will be required to be confirmed by the organization through an official means of contact as listed on the organization's website.
    1.4. Career Development Centre staff will contact the organization using contact information provided on the organization website for confirmation that the individual applying for an employer account on behalf of the organization has authorization to create an account and post job opportunities for the organization.
    1.5. Employer accounts that cannot be confirmed with the organization will be deleted without notice.
    *Professional licensed home-based businesses that do not have a website will be contacted via telephone for confirmation of the employer's business and job posting needs. Approval of professional licensed home-based business accounts is at the sole discretion of the Career Development Centre staff.
    Accounts created for private individuals are not accepted and will not be approved for use - some exceptions may apply. Accounts will be approved on sole discretion of CDC staff and Manager.

  2. Compliance with Legislation
    2.1. All users of this module, including employers, students, and staff, must adhere to the following provincial legislation:
    2.2. Employment Standards Act (BC): All job postings must comply with the Employment Standards Act of British Columbia, which sets out minimum standards for wages, working conditions, and other employment rights.
    2.3. Pay Transparency Act (BC): Where applicable, job postings must include wage or salary information as required by the Pay Transparency Act, unless an exemption applies.
     
  3. Volunteer Positions

    3.1. Definition: Volunteer positions are those where individuals provide services without monetary compensation.
    3.2. Limitations: Only not-for-profit organizations, registered charities, and community groups may advertise volunteer positions through this module. For-profit businesses are not permitted to post unpaid volunteer positions, as this is illegal under the employment Standards Act of BC.
    3.3. Scope: Volunteer positions are not covered by the BC Employment Standards Act and should be clearly identified as such in the posting.

    3.3.1. Volunteer postings must include the amount of time and/or expected commitment of the volunteer.
    3.3.2. Volunteer positions must comply with all municipal, provincial and federal labour and safety regulations.
    3.3.3. Volunteer postings must meet all local, provincial and federal legislation and regulations regarding non-discrimination of any individual or group.
    3.3.4. Volunteer postings may not require the volunteer to pay fees or fundraise in order to contribute to the costs of their participation as a volunteer.

  4. Paid and Unpaid Internships

    4.1. General Rule: All substantive work performed by individuals must be compensated at least at the minimum wage rate, unless a specific exemption applies.
    4.2. Unpaid Internships: Unpaid internships are illegal in British Columbia and as such will not be accepted.
    4.3. Practicum: Unpaid practicums are only permitted if the position is part of a formal educational program and is required for academic credit or as part of the curriculum. As such, unpaid practicum positions will not be accepted for public posting.   5. Job Posting Requirements

    5.1. Transparency: All job postings must clearly state whether the position is paid or unpaid (where permitted), the wage or salary (if paid), and any requirements related to educational status for unpaid positions.
    5.2. Accuracy: Job postings must accurately represent the nature of the work, compensation, and conditions of employment. Misleading or deceptive postings will be removed and may result in suspension of module access.
    5.3. Please note that any advertisement asking students for an upfront payment or a photograph of themselves can be considered discriminatory/unethical and may be declined. Any start-up costs (for example, clothing, equipment, product, licensing fee) must be clearly identified in the job posting.

    5.5.3. Job postings from placement agencies that charge fees to applicants.
    5.5.4. Job postings where there are currently no available openings.
    5.5.5. Job postings containing inappropriate information including offensive or illegal language of content, defamatory statements, inflammatory or discriminatory content based on gender, sexual orientation, age, religious affiliations, disability or ethnicity or any commercial solicitation and/or advertising, morally offensive job advertisements.
    5.5.6. Job postings that include unpaid training as a condition of hiring.
    5.5.7. Commission-only based jobs.
    5.5.8. Job postings for the recruitment of replacement workers during a labour dispute
    5.6. Capilano University Career Development Centre reserves the right to ask third party placement agencies for the name of their client in relation to a specific job opportunity.
    5.7. Capilano University Career Development Centre does not authorize duplication of postings merely to ensure more prominence for the advertisement.

  6. User Responsibilities

    6.1. Employers: Must ensure all postings comply with the above requirements and are responsible for any claims or disputes arising from non-compliance.
    6.2. Students/Applicants: Should review postings carefully and report any suspected violations to Capilano University Career Development Centre (cdc@capilanou.ca)
    6.3. Institution: Reserves the right to remove any posting that does not comply with these terms or applicable legislation.

Consequences of Non-Compliance
Violations of these terms may result in the removal of job postings, suspension of module access, and referral to relevant authorities as required by law.
This policy ensures that all users of the online job posting module are aware of and comply with British Columbia's legal requirements regarding employment, pay transparency, and the use of volunteer and internship positions.

Limitation of Liability
Under no circumstances shall Capilano University or the Career Development Centre, their Assigns and Successors, officers, employees, or agents, be liable for any claims, actions, injury, loss, damage (including special, direct, indirect, incidental or consequential damages) or expense, including, without limitation, loss of revenue or profit or savings, lost or damaged data, or other commercial or economic loss, arising in any manner whatsoever from (i) your acts, omissions or conduct; (ii) any use or inability to use Career Hub, and (iii) any lack of availability or delay in providing Career Hub. This section shall apply whether or not liability results from tort (including negligence), contract (including breach of fundamental terms or conditions) and whether Capilano University Career Development Centre knew of or ought to have known of the possibility of such damages.

Termination of Use
Capilano University Career Development Centre will terminate access automatically if, as an employer or third party acting on behalf of an employer:

  1. a) You fail to comply with any of its terms and regulations. For greater clarity, the termination shall be effective on the date that you failed to comply with these Terms to any extent.
    b) If your user ID or password are compromised or insecure or suspected of being compromised insecure.
    c) If you change the contact information in the account so that it no longer complies with account requirements listed in these Terms of Use.
    d) If the provided contact information is found to no longer be valid or functional for the purpose of contacting the individual responsible for the account.

If at any time, you, as an employer or third party acting on behalf of an employer, cease to agree to be bound by these Terms of Use or, for any reason wish to terminate your participation with Career Hub, you must immediately cease to access or use the Career Hub.

The Career Development Centre may revoke your access to Career Hub if it determines that false, inaccurate or incomplete information was provided in relation with your profile or a job advertisement related to your profile.

Upon contravention of these Terms of Use, your access to Career Hub will also be terminated.

Note:

Capilano University reserves the right to modify the above stated Terms of Use at any time without notice. Such modification shall be effective immediately upon the change being posted. By accepting these Terms of Use, you understand and agree that it is your sole responsibility as an employer or third party acting on behalf of an employer to consult the Terms of Use for any updates.
